CONSULTANT ENGINEERING, INC. 401(K) PLAN Contribution, Match and Other Plan Policies
- Under the 401(k) provisions of the Plan, the participants may elect to defer a portion of their pre-tax compensation up to current statutory limits determined annually and prescribed by the Internal Revenue Service (IRS).
- The Plan also permits participants to elect to make catch-up contributions and to make additional voluntary contributions of qualified rollovers from other retirement plans.
- Participants cannot elect to defer more than 90% of their compensation in a plan year.
- Unless otherwise elected by the participant, all newly eligible participants will be automatically enrolled in the Plan at a rate of 3% of eligible compensation.
- Under the safe harbor provisions of the Plan, the employer will contribute and allocate to each participant’s matching account an amount equal to 100% of participant elective deferrals up to 4% of participant compensation.
- Participants are immediately vested in their elective deferral contributions, employer safe harbor contributions, and any rollover contributions made to the Plan, plus actual earnings thereon.
- Vesting in the employer’s discretionary matching and profit-sharing contribution portion of the participant’s accounts, plus actual earnings thereon, is based on years of credited service.
- Participants vest at 33.33% annually, beginning with the completion of their first year of service and are fully vested after three years of credited service, or upon the normal retirement date.
- The Plan defines a year of credited service to be a Plan year (January 1 through December 31) with the participant rendering at least 1,000 hours of service.
- Upon death or total disability of a participant prior to retirement, the participant’s account balance shall become fully vested.
